Cruise Vessel Security and Safety Act of 2010

Recently, Brock Christian Hammerstein, 25 years of age, was one of two individuals accused of sexually assaulting a minor on a Dolphin cruise. Once said cruise ship ported, the victim visited a local hospital to report that she was sexually battered. At the time of the assault, the victim and her family were visiting Destin, Florida, and went on one of the Sunset Cruises. While on the cruise, an employee, 22 years of age, served her wine without first requesting her identification.  On the completion of the cruise, said employee invited her back onto the boat. The employee and Hammerstein then took her to the ship’s lower level where they allegedly sexually battered her.  The two men maintain that the victim said she was 24 years of age and that she consented to the sex.

Sexual Assault on Cruise Ships

The Basics of Murder

Two employees on a Royal Caribbean cruise ship were recently arrested after being accused of using sandals to smuggle drugs into Florida. They were bringing drugs into Port Canaveral. One of the two employees was a courier for at least one drug trafficking organization. Police officers began following the employee as he left Port Canaveral and they saw him and another employee smuggling cocaine with the use of sandals. Junior Ellison, 31 years of age, was arrested aboard the cruise ship as he was walking away with the cocaine. It was found that the sandals were purchased from Wal-Mart. It was also later found that each time Ellison left the ship he took a shuttle to a Merritt Island Wal-Mart. Authorities discovered that Ellison would obtain sandals filled with cocaine in St. Maarten and then wear them off the ship.  Ellison would make his trip to Wal-Mart, purchase a new pair of sandals, and then place the cocaine-filled sandals in the Wal-Mart bag to deliver to someone else.

The Basics of Robbery

Cases of gastrointestinal illness (“GI”) have grown to become a serious problem for various cruise lines. The cases are growing in number. Today, there are several cruise lines that are specifically required to report the total number of GI illness cases. These cruise lines are participating in the Vessel Sanitation Program (“VSP”).  

Per the Centers for Disease Control and Prevention (“CDC”) there was a severe gastrointestinal outbreak on the Ocean Princess cruise ship of the Princess Cruises cruise line. From this apparent outbreak, 63 out of 603 passengers (or 10.45%) became ill while on the cruise. Seven crewmembers also became ill. This notable outbreak occurred during the cruise ship’s February 13th through March 7th, 2016 voyage. Among all those sickened, the predominant symptoms were vomiting and diarrhea. In response to this outbreak, the cruise ship’s crewmembers, those not sick, increased their cleaning and disinfection procedures, collected stool samples from the sickened passengers and crewmembers for testing and made daily reports of gastrointestinal illness cases. The CDS Vessel Sanitation Program (“VSP”) is currently monitoring the outbreak and the ship’s response procedures.

Sexual assaults on cruises are, unfortunately, not an uncommon occurrence. The facts are quite scary. One major cruise line recently indicated that there were 173 sexual assaults or rapes reported on their ships during a five-year period. To make matters worse, none of these 173 reports were ever prosecuted. A different major cruise line reported that there are two rapes or sexual assaults per month on each of its cruise ships. Just recently, off the coast of Florida, a cruise line’s steward was charged with sexually assaulting a teenage boy in a cruise ship shower. The steward was charged with lewd and lascivious molestation and sexual battery of a person less than 16 years of age. Investigators maintain that the steward saw the young boy in a ship sauna. The two started talking as they used the facility. To get away from the steward, the boy left the sauna and went to the showers; yet, the steward followed and engaged in inappropriate sexual conduct. 

The Lawsuit
