Cruise Ship Death: Accident or Negligence?
On Jun 30, 2016, a young boy on board the Royal Caribbean fell into a pool on the ship, suffering from injuries during the fall. While initial reports suggested the boy was still alive and in critical condition, it was later reported that his condition worsened. According to the medical examiner’s office of New York City, the boy died of accidental drowning. A preexisting seizure disorder may have also been a contributing factor in the death.
It is not clear at this time whether a lifeguard was on duty, if there was any immediate action taken to revive the boy onsite, or how long the boy was left unattended. Negligence on part of the cruise ship could be a factor in the drowning, especially if lifeguards were absent during this time. As this is a developing story, there is no information on whether the parents of this boy will be pressing charges. There is, however, speculation that some legal action will be taken by the family against the cruise line.
Maritime Law and Cruise Line Deaths
Personal injury or death on a cruise ship typically results in some type of court case and financial settlement, either to alleviate medical care costs or to provide a grieving family with some comfort following a senseless loss. Maritime law cases like these are not typically complicated, particularly in cases of accidental death. If the cruise ship showed any negligence on their part, they need to provide the necessary compensatory action steps to take care of their guests.
